However, any losses incurred or sustained by customers who transmit information by means of email or another internet link shall be borne solely and exclusively by that customer and in no event shall any such losses in whole or in part be borne by Phoenix Publishing House. If you discover that goods have been ordered using your credit/debit card by someone not authorised to do so, Phoenix Publishing House will refund to you the money it receives provided that:
(a) you inform your credit/debit card company and Phoenix Publishing House of the unauthorised purchase as soon as you discover it; and
(b) you co-operate with your credit/debit card company, Phoenix Publishing House, and, if necessary, the police in relation to the unauthorised use.

Permission is granted to electronically copy and print in hard copy portions of this site for the sole purpose of placing an order with Phoenix Publishing House or using this site as a shopping resource. When you register with the Phoenix Publishing House website, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. The contract between us
Phoenix Publishing House must receive payment of the whole of the price for the goods that you order before your order can be despatched. Orders are charged at the time of placing the order and you will receive an order confirmation email with your order details. Phoenix Publishing House will confirm that your order has been processed by sending an email to you at the email address you provide in your order form along with your receipt. Phoenix Publishing House’s receipt of your payment brings into existence a legally binding contract between us.
Price
Phoenix Publishing House reserves the right at any time to revise its prices without notice, and Phoenix Publishing House makes no representations or warranties about the accuracy of said prices. However, we will take all reasonable steps to inform customers of any price changes before orders are processed and charges are made, and will give customers the option of cancelling any orders before said charges are brought into effect.
You will be required to pay extra for delivery to some destinations or by certain delivery methods (such as overnight, courier or signed-for services) and it might not be possible for us to deliver to some locations.
Withdrawal by you from the contract
You may withdraw your order for goods at any time up to the end of the fourteenth day after receipt of your order even if you have then already received the goods. You do not need to give Phoenix Publishing House any reason for withdrawing your order nor will you have to pay any penalty.
The only circumstances in which you cannot withdraw your order are where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered.
To withdraw your order you must notify Phoenix Publishing House in writing via email to orders@firingthemind.com.
If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their sealed package, you must send them back to the Phoenix Publishing House contact address at your own cost and risk. If you withdraw your order but Phoenix Publishing House has already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to Phoenix Publishing House at the Phoenix Publishing House contact address at your own cost and risk as soon as possible.
Once you have notified Phoenix Publishing House that you are withdrawing your order, any sum debited to Phoenix Publishing House from your credit/debit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by Phoenix Publishing House in the condition they were in when delivered to you.
Availability of goods you order
If Phoenix Publishing House has insufficient stock to deliver the goods ordered by you, Phoenix Publishing House will notify you by email at the address given by you in your order form. You will be given the option to wait until the goods are available or to receive a refund to your credit/debit card (or original method of payment). The refund will be made as soon as possible and in any event within 30 days of your order. Phoenix Publishing House will not be obliged to offer any additional compensation for disappointment suffered.
In relation to journal subscription payments, the payment received will be to cover the current calendar year and the journal issues will be despatched as soon as they are available.
Delivery of goods to you
Phoenix Publishing House will deliver the goods ordered by you to the address you give Phoenix Publishing House for delivery at the time you make your order.
You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and Phoenix Publishing House will not be liable for their loss or destruction.
Customs Charges
If you are ordering goods for delivery outside of the EU, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that Phoenix Publishing House has no control over additional charges in relation to customs clearance. Phoenix Publishing House recommends that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order.
Liability
If the goods Phoenix Publishing House delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Phoenix Publishing House shall have no liability to you unless you notify Phoenix Publishing House of the problem in writing via email to orders@firingthemind.com within 10 working days of the delivery of goods in question.
If you do not receive goods ordered by you within 30 days of the date on which we despatched them to you (with the exception of items sent via surface post), Phoenix Publishing House shall have no liability to you unless you notify Phoenix Publishing House of the problem in writing via email to orders@firingthemind.com within 40 days of the date on which you ordered the goods.
If you notify a problem to Phoenix Publishing House under this condition, Phoenix Publishing House’s only obligation will be one of the following options:
• to make good any shortage or non-delivery;
• to replace or repair any goods that are damaged or defective; or
• to refund to you the amount paid by you for the goods in question in whatever way Phoenix Publishing House chooses.
Phoenix Publishing House will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Phoenix Publishing House under this condition and Phoenix Publishing House shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the paragraph above.
Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Phoenix Publishing House’s liability to you for any death or personal injury resulting from its negligence.
Force Majeure
Phoenix Publishing House shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
Invalidity
If any part of these conditions is unenforceable (including any provision in which Phoenix Publishing House excludes its liability to you) the enforceability of any other part of these conditions will not be affected.
Governing Law
The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.
Entire Agreement
These terms and conditions, together with the current Phoenix Publishing House website prices, delivery details, and Phoenix Publishing House contact details, set out the whole of our agreement relating to the supply of the goods to you by Phoenix Publishing House.
These terms and conditions cannot be varied except in writing signed by a director of Phoenix Publishing House. In particular nothing said by any sales person on behalf of Phoenix Publishing House should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Phoenix Publishing House. Phoenix Publishing House shall have no liability for any such representation being untrue or misleading.
Interpretation
In these terms and conditions:
• “Phoenix Publishing House” means Phoenix Publishing House Ltd;
• any connected organisation that actually supplies goods ordered by you and any successor to its business;
• “working day” means every day of a calendar year apart from weekends and statutory and public holidays;
• “us” means Phoenix Publishing House and you together; and
• “you” and “your” means the person ordering goods under these terms and conditions.
